The Scope of this Privacy Policy

This Privacy policy covers how we use and disclose Personal Information that we gather from you beginning at the time you first access one of our Services.

By using our Services, you agree to our collection, use, and disclosure of your Personal Information by this Privacy Policy. If you do not agree with the practices described in this Privacy Policy, please do not use the Services.

Vheda Health may collect various Personal Information from you and certain devices that you use. This collection starts from the time you access our Services. The information we gather enables us:

  • To provide you with Services,
  • To respond to your questions,
  • To deliver customized content,
  • To understand who is using our Services,
  • To personalize and improve our Services,
  • To manage the security of the Services,
  • The Personal Information You Provide to Us

We receive and store any information you enter on Services. The Personal Information you provide may include your full name, gender, contact information (e.g. your phone number, your home address), certain health information (e.g. chronic condition, weight readings, blood glucose and blood pressure readings, oxygen saturation readings, heart rate, and other activities), and any other information or data that you provide when using our Services.

Through Vheda Health programs, we may enable you to share information with us using digital equipment that we provide you that assists in tracking changes in your health and supplies that information automatically to us. We refer to these devices as “Vheda Health devices.” Vheda Health devices are pre-configured to supply information to us and will share information about you and your health without requiring additional authorizations from you. Examples of Personal Information that we may receive from Vheda Health Devices include your weight, blood pressure readings, blood glucose readings, and oxygen saturation readings.

Vheda Health will use the Personal Information you provide for the purposes described above and to provide you with a personalized experience in using the Services. You can choose not to provide us with certain information, but if you do make that choice, we may be unable to provide you with access to or use of many of our Service features.

Phone Communications

We may receive a confirmation when you are not participating in our Services. We use this confirmation to initiate a phone call with you so that you resume using our Services. When you receive a call from us, you can opt out of receiving further calls by making this request to the phone representative. Please keep in mind, that opting out of further phone calls may limit program reminders and other valuable Service features.

Electronic Communications

We may receive a confirmation when you are not participating in our Services. We use this confirmation to initiate a message reminding you to resume using our Services. When you receive this message from us, you can out opt to receive calling our member support. Please keep in mind, that opting out of further messages may limit program reminders and other valuable Service features.

Information We Collect

Your health plan will provide us with information so that we can provide our services to you. Additionally, we may collect information about your activity on our Services. This is accomplished to provide you with an optimal experience. This may include:
Mobile App Use. When using our app, we may collect certain information about such use, including your mobile device ID, operating system, you activity with the App, and length of time in the App.

Scripts

A script is a programming code designed to collect information about your interaction with the Site, Apps, and other aspects of our Services, such as a link you may click on. These scripts are temporarily downloaded on your device. These scripts remain active only while you are connected to the Services and then are deactivated or deleted.

This Privacy Policy refers only to the use of scripts by Vheda Health and does not cover the use of any Tracking Technologies by advertisers or any other third parties. You consent to potentially encounter third-party Tracking Technologies in connection with your use of the Services and accept that this Privacy Policy does not apply to the Tracking Technologies or practices of those third parties. To confirm how any third party collects or uses your information, please refer to that third party’s website.

How We Share Personal Information

Vheda Health respects the privacy of its users and will never sell your Personal Information to anyone for any reason. In connection with your participation in the Vheda Health program, we may share Personal Information, when necessary, with your doctor, hospitals, and other third-party healthcare providers. If Services are provided through your health plan, we may share the Personal Information you provide with your health plan. All such information will be provided by applicable laws, including without limitation the Health Insurance Portability and Accountability Act of 1996 and other regulations. We may use de-identified data for various business purposes including product enhancement and improvement.

Protection of Vheda Health and Others

We may release your Personal Information when we believe in good faith that releasing that information is necessary to comply with applicable law, to enforce our conditions of use and other agreements, or to protect the rights, property, or safety of Vheda Health, our employees, our users, or others. If necessary and required by law, we will disclose any breach of the security, confidentiality, or integrity of your Personal Information, including, without limitation, breaches of your unencrypted, electronically stored “personal information” or “medical information” (as defined by applicable laws).

Data Deidentification

Vheda Health may remove Personal Information to create anonymous data, which we may later aggregate. This data cannot be used to identify any individual, and we will not attempt to re-identify later or allow others to do so. Vheda Health may use this data for the purposes of evaluating, analyzing, researching, or enhancing Vheda Health programs and services, or business purposes. When an applicable law requires we use a particular method of de-identification, we will comply with that law. Otherwise, we will use a method that is appropriate under the circumstances and which would not reasonably identify you.

Data Protection and Security Policy

We maintain industry-standard security measures, including SSL encryption, to protect sensitive data such as when it is stored by Vheda Health and when you send it to us. Further, we employ industry-standard administrative, physical, and technical safeguards to ensure the protection of information under our control from unauthorized access, use, and disclosure. Additionally, when we collect Personal Information, we will always do so by federal and state laws, including HIPAA.

For your privacy and security, your user account is protected by a password. To avoid unauthorized access to your account, we recommend you safeguard your password by not sharing it with anyone.

We maintain Personal Information for registered users by our records retention policies or as required by law, and you have the right to access or modify the information we maintain regarding you at any time.
While we take great care to ensure the protection of your Personal Information, we cannot guarantee that others acting unlawfully will not succeed in efforts to undermine our security measures. Unauthorized entry, access, and use of our Sites, Apps, or Services may compromise the security of your information at any time.

Privacy Choice and Control

You can review, modify, or request the removal of personal information we collect about you.  Certain information may be retained, however, to satisfy legal obligations. We may in some circumstances provide you with the ability to choose to limit the types and frequency of communications you receive from Vheda Health. You may choose to end your relationship with Vheda Health at any point.

Deleting Your Personal Information

Vheda Health is required to maintain Personal Information, including any PHI, received as a business record. Therefore, we cannot eliminate your Personal Information from our records. However, even if you stop using our Services for any reason, we will protect your Personal Information in accordance with this Privacy Policy as if you were still using the Services.

Changes to this Privacy Policy

We reserve the right to change any terms of this Privacy Policy at any time and for any reason at our discretion. Any changes in our Privacy Policy will be prominently posted on the Privacy Policy page linked from each of our services so that you are aware of any changes in the data we collect and how we use it. You are responsible for checking this privacy policy periodically for changes. If any changes are made to this Privacy Policy, we will notify you in a reasonable time period prior to the new terms taking effect. By continuing to use our Services, you agree to be bound by the updated Privacy Policy. If you disagree with any changes, you must stop using our Services.

Your California Privacy Rights

Under California Civil Code Section 1798.83, California customers are entitled to request information relating to whether a business has disclosed personal information to any third parties for the third parties’ direct marketing purposes.  As explained elsewhere in this Privacy Policy, Vheda Health will not sell or transfer your personal information with third-party companies for their direct marketing purposes without your consent. California customers who wish to request further information about our compliance with this statute or who have questions more generally about our Privacy Policy and our privacy commitments to our customers and Site users should not hesitate to contact us or call us.
